• Complexity: No complex machinery, mecha, or highly technical designs (e.g., engines, detailed cockpits).

Important Notes:

• NSFW References: I am comfortable working with NSFW reference sheets, provided that the character's design, markings, and anatomy are clearly visible and recognizable.
• Art Style: I work exclusively in my own artistic style. Please refrain from asking me to imitate or copy the style of another artist. I am happy to take inspiration from themes or vibes, but the final execution will always be my own!

1. Subject of Agreement: Digital Goods Only

• Digital Product: All commissions are digital goods only. No physical product (e.g., prints, canvases, or original paper drawings) will be shipped. 
• Delivery: Delivery will be made in digital format (e.g., .png, .jpg, or .pdf) via email or a download link.

2. Copyright & Usage Rights

• Ownership: I (the Artist) retain full copyright and ownership of the artwork. Copyright is not transferable.
• Private Use: The Client receives a simple license for strictly personal use. Commercial use (e.g., advertising, merchandising, NFTs, resale) is prohibited unless a separate commercial license is purchased.
• Third-Party Rights: Rights to existing character designs remain with their respective creators. My rights apply only to the specific artistic execution I provide.
• Integrity of Work: The Client may not independently alter, paint over, or apply filters to the artwork that distort the artistic style.

3. Anti-AI Clause

• Prohibition: The use of the artwork for training Artificial Intelligence (AI), machine learning models, or processing through generative AI tools is strictly prohibited.

4. Revisions & Correction Process

• Correction Limit: Up to 3 minor revisions (e.g., color adjustments, small details) are included in the price during the sketching/drafting phase.
• Major Changes: Significant changes to the concept (e.g., a completely different pose or composition) are not included in the standard revisions and will incur additional costs.
• Finality: Once the artwork is finished and delivered, no further corrections will be made. Any subsequent change requests will be treated as a new commission.

5. Payment, Cancellation & "Kill Fee"

• Final Sale: Once payment (or a deposit) has been made, the purchase is final and cannot be withdrawn. No refunds will be issued for work steps already completed.
• Right to Terminate: I reserve the right to cancel the commission at any time if the cooperation proves to be difficult or communication becomes unreasonable.
• 50% Kill Fee: In the event of a cancellation—whether by the Client or by me (due to complications in cooperation)—50% of the total agreed price will be retained as a fee for work already performed.

6. Acceptance of Terms: 

By paying the invoice (full or partial), the Client confirms that they have read, understood, and agreed to these Terms of Service in their entirety 

All prices are final. Due to the small business status (according to § 19 UStG), no value-added tax (VAT) is charged or displayed." 

Turnaround Time & Deadlines

• General Timeline: My goal is to complete every commission within the same month it was accepted. However, please understand that due to the volume of orders or the complexity of a piece, slight delays may occur.
• No Fixed Deadlines: I generally do not work with fixed deadlines for standard commissions.
• Special Projects: If you have a specific date in mind (e.g., for a birthday or a convention), this must be clearly communicated and agreed upon before the start of the project. Special deadlines may be subject to a priority fee.

 Priority & Rush Fees: If you require a guaranteed deadline, a priority fee will be applied. This typically ranges from 25% to 100% of the total price, depending on the urgency and complexity of the project. Please contact me for a specific quote.

I reserve the right to use all commissioned artworks for promotional purposes. This includes, but is not limited to, displaying the work on my website, portfolio, and social media platforms. As the artist, I retain the copyright to the artwork created. If your commission is a surprise or intended for a specific release date, please let me know in advance! I am happy to delay the publication of the artwork until your project or gift has been revealed.

Allgemeine Geschäftsbedingungen (AGB) – Kunstaufträge (Commissions)

1. Vertragsgegenstand: Ausschließlich digitale Güter

• Digitale Ware: Bei allen Aufträgen handelt es sich ausschließlich um digitale Güter. Es erfolgt kein Versand von physischen Waren (wie Drucke oder Originalzeichnungen), sofern dies nicht ausdrücklich und schriftlich gegen Aufpreis vereinbart wurde.
• Lieferform: Die Lieferung erfolgt in digitaler Form (z. B. als .png oder .jpg) per E-Mail oder Download-Link.

2. Urheberrecht & Nutzungsrechte

• Eigentum: Alle erstellten Werke bleiben mein geistiges Eigentum (Urheberrecht).
• Privater Gebrauch: Der Kunde erhält ein einfaches Nutzungsrecht für den rein privaten Gebrauch. Eine kommerzielle Nutzung (Werbung, Verkauf, Merchandising) ist strikt untersagt.
• Rechte an Charakteren: Die Rechte an der dargestellten Figur verbleiben beim ursprünglichen Schöpfer. Meine Rechte beziehen sich ausschließlich auf die künstlerische Ausführung des Bildes.
• Veränderungsverbot: Das fertige Bild darf vom Kunden nicht eigenständig verändert, übermalt oder durch Filter verfremdet werden.

3. KI-Schutzklausel (Anti-AI)

• Nutzungsverbot: Die Nutzung der Werke für das Training von Künstlicher Intelligenz (KI/AI), Machine Learning Modellen oder die Bearbeitung durch generative Bild-Tools ist strafrechtlich untersagt.

4. Korrekturen & Revisionsprozess

• Korrektur-Limit: Während des Entwurfsprozesses (Skizzenphase) sind bis zu 3 kleine Korrekturen (z. B. Farbanpassungen, kleine Details) im Preis enthalten.
• Große Änderungen: Grundlegende Änderungen am Konzept (z. B. eine komplett andere Pose der Figur) sind nicht in den Standard-Korrekturen enthalten und werden zusätzlich berechnet.
• Abschluss: Sobald das Bild fertiggestellt und geliefert wurde, werden keinerlei Korrekturen mehr vorgenommen.

5. Zahlung, Rücktritt & Abbruchgebühr

• Kein Widerruf: Sobald die Zahlung (oder Anzahlung) geleistet wurde, ist ein Rücktritt vom Kauf ausgeschlossen. Es erfolgt keine Rückerstattung für bereits geleistete Arbeitsschritte.
• Recht auf Abbruch: Ich behalte mir das Recht vor, die Zusammenarbeit jederzeit abzubrechen, falls sich diese als schwierig oder unzumutbar erweist.
• 50%-Regelung ("Kill Fee"): Im Falle eines Abbruchs durch den Kunden oder durch mich (aufgrund von Komplikationen in der Zusammenarbeit) werden 50 % des vereinbarten Gesamtpreises als Aufwandsentschädigung einbehalten. 

6. Anerkennung der Bedingungen: 

Mit der (vollständigen oder teilweisen) Zahlung der Rechnung bestätigt der Kunde, dass er diese Nutzungsbedingungen (T.O.S.) vollständig gelesen, verstanden und akzeptiert hat. 

Alle angegebenen Preise sind Endpreise. Aufgrund der Kleinunternehmerregelung gemäß § 19 UStG wird keine Umsatzsteuer erhoben und ausgewiesen. 

Bearbeitungszeit & Deadlines

• Zeitlicher Rahmen: Mein Ziel ist es, jede Commission innerhalb des Monats fertigzustellen, in dem sie angenommen wurde. Bitte habe jedoch Verständnis dafür, dass es aufgrund des Auftragsvolumens oder der Komplexität eines Werks zu leichten Verzögerungen kommen kann.
• Keine festen Deadlines: Bei Standard-Aufträgen arbeite ich in der Regel nicht mit festen Deadlines.
• Besondere Projekte: Falls du ein bestimmtes Datum im Kopf hast (z. B. für einen Geburtstag oder eine Convention), muss dies vor Projektbeginn klar kommuniziert und von mir bestätigt werden. Für solche festen Termine kann eine Prioritätsgebühr anfallen.

Prioritäts- & Eilgebühren: Wenn du eine garantierte Deadline benötigst, wird eine Prioritätsgebühr erhoben. Diese liegt in der Regel zwischen 25 % und 100 % des Gesamtpreises, abhängig von der Dringlichkeit und dem Aufwand des Projekts. Bitte kontaktiere mich für ein individuelles Angebot.

Ich behalte mir das Recht vor, alle fertiggestellten Commission-Arbeiten zu Werbezwecken zu nutzen. Dies beinhaltet die Veröffentlichung in meinem Portfolio, auf meiner Website sowie auf meinen Social-Media-Kanälen (z. B. für Work-in-Progress-Posts oder als Beispiele für mein Angebot). Das Urheberrecht bleibt beim Künstler.  Falls deine Commission eine Überraschung ist oder für ein bestimmtes Datum geplant ist, gib mir bitte im Vorfeld Bescheid! Gerne warte ich mit der Veröffentlichung des Kunstwerks in meinem Portfolio oder auf Social Media, bis dein Projekt oder Geschenk offiziell enthüllt wurde.
